1. General

The General Terms and Conditions have been drawn up in accordance with consumer protection regulations, based on the recommendations of the Chamber of Commerce and Industry of Slovenia and international codes for online and electronic commerce. The online store "Gina's Woofs" (hereinafter referred to as the "online store") is operated by the company SPLETNA TRGOVINA GINAS WOOFS, Matjaž Kljajić, sp, which is also a provider of electronic commerce services (hereinafter referred to as the "Merchant").

The buyer is bound by the general terms and conditions that are valid at the time of purchase (submission of an online order). When placing an order, the user is each time specifically reminded of the general terms and conditions of business and confirms his/her familiarity with them by submitting an order.

By registering in the online store, the visitor obtains a username that is the same as their email address and a user password that the user determines. The username and password unambiguously identify the user and link them to the entered data. By registering, the visitor confirms and guarantees that they are a person with full business capacity. By registering, the visitor becomes a user and member of Gina's Woofs. Both the guest and the user acquire the right to purchase. By purchasing a product, the user becomes a buyer. Registration is also possible during the purchase process. You can edit your data and e-newsletter subscription later, if necessary, in your user account.

These General Terms and Conditions define the operation of the online store, the rights and obligations of the visitor, user and buyer, and the business relationship between the Merchant and the user as the buyer of products from the online store's offer.

2. Accessibility of information

The merchant undertakes to always make the following available to the user:

data on the identity of the Merchant (primarily the company name and registered office and the register number where the company is registered);

contact information that enables the user to communicate quickly and efficiently with the Merchant (email address, telephone number, etc.);

information about the essential characteristics of the products offered by the online store, including any warranties (if there is no warranty written next to the product, there is no warranty for that product)

information on prices, which must be clearly stated and it must be clear whether the price includes VAT or not;

information about the availability of products from the online store;

the method and conditions of delivery of products or performance of services, in particular the place and time of delivery;

information about the payment method;

information on the validity period of the offer from the online store;

information about the period within which it is still possible to withdraw from the contract and the conditions for withdrawal;

information about the possibility of returning products or withdrawing from the contract

information about the user complaint procedure and details of the Merchant's contact person for user contacts.

3. Product offering

Due to the nature of online business, the product offering in the online store can change and be updated frequently and quickly.

4. Payment methods

The merchant provides the user with the following payment methods for purchasing products from the Gina's Woofs online store:

BY PROVISIONAL INVOICE*: By advance payment of the purchase price to the Merchant's transaction account according to the prepared proforma invoice, which we send to your e-mail; the reservation of the ordered items is made immediately after the purchase, the payment deadline for the proforma invoice is three (3) days, and the reservation for the ordered items is valid for the same period. After the payment deadline has expired, or at the latest seven (7) working days from the date of the sent proforma invoice, the order is canceled and the reservation is released. Holidays and weekends are NOT included in the payment deadline. If the Merchant receives payment after the expiration of the validity period of the proforma invoice and has not confirmed the extension of validity and payment of the proforma invoice, he is not obliged to return the purchase price paid, in the event that the item in question is sold or no longer in stock due to the release of the reservation.

PAYMENT ON CASH*: You pay for the ordered items to the package delivery person from an authorized delivery service. Payment on cash on delivery is possible for purchases worth up to €200. In case of non-collection, we will proceed in accordance with the general terms and conditions.

PAYMENT WITH PAYMENT CARDS*: is carried out through the Shopify Payments payment system, which is owned by Shopify. Card information is not recorded on the company's server, so your security is 100% guaranteed. Shopify Payments ensures maximum transaction security. Credit card authorizations are performed in real time with immediate verification of data with banks. Payment is possible with the following cards: Visa, Visa Debit, Mastercard, Debit Mastercard, American Express.

PAYPAL*: Secure payment via PayPal.

*The payment amount already includes shipping and other delivery costs, if delivery is chargeable, but with free delivery you only pay the value of the ordered items.

5. Prices

The online price applies to all registered users of the Merchant's online store.

All prices in the online store are listed in euros. The merchant is liable for VAT. All prices in the online store are product prices and do not include delivery costs (see points 3 and 12). All prices apply only to electronic orders of products through the online store.

Discounts are not cumulative and promotions are mutually exclusive, unless explicitly stated otherwise.

All prices are valid at the time of placing the order and do not have a predetermined validity, therefore they are valid only until their respective change. Despite the Merchant's extraordinary efforts to provide the most up-to-date and accurate information, it may happen that the price information is incorrect. In the case from the previous sentence and in the event that the price of the product changes during the processing of the order, i.e. from the moment of placing the order until the confirmation of the order, the Merchant will:

notify the user (buyer) of this and inform them of the new prices, in which case the user (buyer) has the option to change their order or cancel it in part or in full, or confirm the order at the new prices, all at no additional cost; or

enable the user (buyer) to withdraw from the purchase and at the same time offer them a solution that will be mutually beneficial and satisfying.

Funds paid in through vouchers, other bonuses and pro forma invoices do not bear interest.

The price of goods in the online store is not adjusted based on automated decision-making.

6. Purchase process

  1. Order accepted

After placing an order, the user (buyer) receives a notification from the Merchant by e-mail that the order has been accepted. Within 1 hour of receiving this notification, the user (buyer) has the option to cancel the order without consequences. Apart from the option to cancel, the user (buyer) cannot change the content of the order after placing the order. The user (buyer) always has access to comprehensive information about the status and content of an individual order in his profile on the Merchant's website.

2. Order confirmed

If the user (buyer) does not cancel the order, the order will be processed further. Upon receipt, the merchant will review the order, check the availability of the ordered products, and either confirm the order or reject it with a reason. The merchant may also contact the user (buyer) by phone to verify the data or ensure the accuracy of the delivery.

3. Goods shipped

The merchant prepares and ships the ordered products within the agreed deadline and notifies the user (buyer) of this by email.

7. Purchase contract and invoice issuance

The trader issues an invoice in written or electronic form to the user who purchases a product from the online store, with itemized costs. The purchase agreement in the form of a purchase order is stored in electronic form on the trader's server and is accessible to the user (buyer) at any time in his/her user profile. The purchase agreement is concluded in the Slovenian language.

8. Coupons, gift certificates, vouchers and loyalty program

You can use online store coupons with a password you have obtained or a publicly published password. To use a coupon, you must first select the desired product(s), then click on the cart and select "View cart". The "Use coupon code" option will appear, where you enter your password in the field and click "Use coupon". The program will automatically calculate the discount at the end of the purchase.

9. Right to withdraw from purchase, return of products

In accordance with the Consumer Protection Act (ZVPot-1), in contracts concluded at a distance or outside business premises, the consumer has the right to notify the company within 14 days of withdrawing from the contract, without having to give a reason for their decision.

The consumer may submit the notice of withdrawal to the company on a form or by an unambiguous statement clearly indicating that he is withdrawing from the contract (it may also be oral, e.g. given by telephone). The consumer is deemed to have given the notice of withdrawal on time if he sends it within the deadline set for withdrawal from the contract.

In connection with the withdrawal from the contract, the consumer only bears the costs of returning the goods.

The consumer is liable for any diminished value of the goods if the diminished value is the result of conduct that is not strictly necessary to establish the nature, properties and functioning of the goods.

We recommend that you use a delivery service that allows tracking of the shipment and that you prepare the goods appropriately for transport (you can use the original packaging or other suitable safe packaging). Any return costs are covered by the buyer. We do not accept COD shipments.

In the event of withdrawal from the contract, the company shall immediately, or at the latest within 14 days of receiving the notification of withdrawal from the contract, refund all payments received. The company shall refund the payments received to the consumer using the same means of payment as the consumer used, unless the consumer has expressly agreed to use another means of payment and the consumer does not bear any costs as a result. The consumer is not entitled to reimbursement of additional costs incurred if he has expressly opted for a type of delivery other than the most affordable standard delivery offered by the company. In the case of a sales contract, the company may withhold the refund of payments received until the returned goods have been received or until the consumer has provided proof that he has sent the goods back, unless the company offers the option of collecting the returned goods himself.

10. Material defect and warranty

The seller is liable for any non-conformity of the goods that exists at the time of delivery of the goods and that becomes apparent within two years of delivery of the goods.

11. Purchase for legal entities

The purchase process for legal entities is the same as the purchase process for individuals, except that when registering a user, the company is entered and the user confirms their agreement to the terms of use.

Legal entities do not have the option to withdraw from the purchase contract within 15 days of receipt without giving a reason. However, they can claim defects within the scope of a material defect or warranty.

The Gina's Woofs online store offers the following payment methods for legal entities:

BY PROFIT INVOICE: By advance transfer of the purchase price to the Merchant's transaction account according to the prepared profit invoice, which we send to your email. (see point 4 - PROFIT INVOICE)

12. Delivery

The Merchant will deliver the ordered products to the user (buyer) within the agreed deadline. The Merchant's contractual partners for delivery of shipments are GLS Slovenia, GENERAL LOGISTICS SYSTEMS, logistic services doo and POŠTA SLOVENIJE doo. The Merchant reserves the right to choose another delivery service if this will enable it to fulfill the order more efficiently.

The delivery time for products that are in stock, for delivery addresses in Slovenia, is expected to be the next working day or up to 2 working days for orders placed after 12 noon.

The flat rate delivery price is €3.90 per package. The price includes order processing costs, packaging costs and delivery costs.

Every product from the online store is available within a reasonable timeframe and is shipped in the shortest possible time. Delivery of placed orders is only possible within Slovenia.

Pošta Slovenije will notify the recipient of the scheduled delivery of the package via SMS or e-mail one day in advance. In the event that you are not at the specified address at the time of delivery, the Pošta Slovenije courier will leave a note in your mailbox with a contact phone number, where you can order a re-delivery, which is free of charge. Pošta Slovenije will keep your package for 4 days, after which it will be returned to the sender.

13. Security and protection of personal data

The merchant uses appropriate technological and organizational means to protect the transmission and storage of personal data. The user is also responsible for security, namely by ensuring the security of their username and password and for appropriate software and anti-virus protection of their computer.

The merchant (Gina's Woofs) is committed to permanently protecting all user personal data in accordance with ZVOP-1.

The Merchant (Gina's Woofs) stores the Buyer's data for an indefinite period of time, such as: name, surname, e-mail address, contact telephone number, address, country of residence, time and date of registration and archive of communication with the Merchant (with Gina's Woofs). The Merchant (Gina's Woofs) will use the specified personal data exclusively for its own needs (delivery, sending materials, offers, invoices) and other necessary communication with the Buyer. The Buyer's data will not be disclosed to unauthorized persons under any circumstances.

14. Communication and e-newsletter

The merchant (Gina's Woofs) will contact the user (buyer) using distance communication, unless the user (buyer) explicitly objects to this.

The emails will contain:

a clear and unambiguous indication that the advertising messages are

the sender of Gina's Woofs will be clearly visible

Campaigns, promotions and other marketing techniques will be marked and the conditions for participation in them will be clear.

The method of unsubscribing from receiving e-newsletters will be clearly presented.

15. Child protection

The online store merchant does not accept orders from someone who is known or suspected to be a child without the express permission of the child's parents or guardians. The online store merchant does not offer free access to products or services that are harmful to children.

The merchant will not accept any personal data concerning children without the express permission of parents or guardians, nor will it release data received from children to third parties other than parents or guardians.

Any communication aimed at children will be age-appropriate and will not exploit children's trustworthiness, lack of experience or sense of loyalty.

16. Privacy Policy

Part of these General Terms and Conditions is also the Privacy Policy, which is accessible in the "Privacy Policy" section.

17. Limitation of liability

The risk of loss or damage to the goods shipped shall pass from the company to the consumer when the goods are physically received or when the goods are physically received by a third party other than the carrier and designated by the consumer for this purpose. If the consumer has ordered transport from a carrier not offered by the company, the risk of loss or damage to the goods shall, notwithstanding the previous paragraph, pass to the consumer upon delivery of the goods to the carrier, without prejudice to the rights that the consumer has against the carrier.

18. Failure to accept products

The buyer is obliged to collect the ordered items within a certain time from the receipt of the electronic notification of the completed order, SMS confirmation of the completed order or confirmation by e-mail. If the buyer does not collect the ordered items that are sent with cash on delivery in any case, and they are returned to the company's address after the waiting period at Pošta Slovenije (4 days) has expired, this is NOT considered a withdrawal from the contract, as the latter is still validly concluded and it is a unilateral, unannounced withdrawal of the buyer from the contract. In the event of non-collection, the buyer is thus responsible for paying the costs of additional shipping/return of the items to the company, for paying the economic damage incurred due to the inability to advertise the ordered items that have been in distribution for 4 days or more. In the event of non-collection, the case will be handed over to the legal department, which will, under our authority, further arrange the payment and recovery of the incurred costs and damage.

19. Complaints, disputes and application of law

The trader complies with applicable consumer protection regulations. The trader has an effective complaints handling system in place and has a designated person with whom the user (buyer) can contact by phone or email in case of problems. In case of problems, the user (buyer) can contact the tel. no. 041 213 451 for help. The user (buyer) can submit a complaint to the email address hello@ginaswoofs.com . The complaint handling process is confidential.

The trader will confirm receipt of the complaint within five working days and inform the user (buyer) of how long it will take to process it and keep them informed about the progress of the procedure. The trader will make every effort to resolve any disputes amicably. If an amicable resolution of the dispute is not reached, the court in Ljubljana has exclusive jurisdiction to resolve all disputes between the trader and the user (buyer). The trader and the user (buyer) as participants in electronic commerce mutually recognize the validity of electronic messages in court.

These General Terms and Conditions and all disputes between the Merchant and the user (buyer) are governed by Slovenian substantive and procedural law, with the exception of rules of private international law that would indicate the application of any other law.

The provisions of the Code of Obligations, the Electronic Commerce Act, the Personal Data Protection Act and the Consumer Protection Act shall apply mutatis mutandis to all relationships and rights and obligations not regulated by these General Terms and Conditions.

20. Out-of-court settlement of consumer disputes

In accordance with legal norms, the online store www.ginaswoofs.com, owned by the company GINAS WOOFS ONLINE STORE Matjaž Kljajić sp, does not recognize any provider of out-of-court consumer dispute resolution as competent for resolving a consumer dispute that a consumer could initiate in accordance with the Out-of-Court Consumer Dispute Resolution Act.

Matjaž Kljajić sp, which, as a provider of goods and services, enables online commerce in the Republic of Slovenia, publishes an electronic link to the online consumer dispute resolution platform (SRPS) on its website. The platform is available to consumers.

The aforementioned regulation stems from the Act on Out-of-Court Resolution of Consumer Disputes, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No. 2016/2004 and Directive 2009/22/EC.

21. Changes to the general terms and conditions

In the event of changes in the regulations governing the operation of online stores, data protection and other areas related to the operation of the online store of the Merchant and in the event of changes in its own business policy, the Merchant may amend and/or supplement these General Terms and Conditions, of which it will inform users in an appropriate manner each time, which includes in particular notification via the website www.ginaswoofs.com. Any changes and/or supplements to the General Terms and Conditions shall enter into force and apply upon the expiry of a period of eight days from the publication of the changes and/or supplements. If the change and/or supplement to the General Terms and Conditions is necessary for compliance with regulations, these changes and/or supplements may exceptionally enter into force and apply in a shorter period.

A user who does not agree with the changes and/or amendments to these General Terms and Conditions must cancel their registration within eight days of the publication of the notice of change and/or amendment to the General Terms and Conditions, otherwise, after the expiry of this period, it shall be deemed that the user accepts the changes and/or amendments to the General Terms and Conditions and no evidence to the contrary shall be admissible. Cancellation of registration shall be made by the user notifying the Merchant of the cancellation in writing.

The General Terms and Conditions were accepted by the company GINAS WOOFS ONLINE STORE Matjaž Kljajić sp, Preserje 30, 5295 Branik on 01.07.2021.

22. Description of technical means for identifying and correcting errors before placing an order

Before the buyer places an order, the REVIEW AND SUBMIT ORDER window opens, with the prompt "Review the above order information and submit it when you are ready." In the entry, you can check the information you have filled in for the purpose of placing the order. In case of incorrect data entry, you can change it by clicking the "EDIT" button. At this step, the buyer can change the customer information, delivery address, delivery method, payment method and billing address.

In case of incorrect product or quantity entry, the customer can return to the cart to correct the information – the "Edit cart" button.

If you have entered the wrong quantity, you can change it at this step. When changing the quantity, you must click on the "+/-" button. If you have added a product that you do not want, you can remove it by clicking on the 'x'.
